TERMS AND CONDITIONS

PLEASE READ THESE TERMS AND CONDITIONS OF USE (“T&C”) CAREFULLY. THESE PRODUCTS AND CONTENT ARE AVAILABLE FOR PURCHASER’S USE ONLY, UPON YOUR AGREEING TO THESE T&Cs. IF YOU DO NOT AGREE TO ALL OF THE T&Cs HEREIN, PLEASE DO NOT USE THE BACKSEAT PILOT CONTENT AND PRODUCTS. BY USING THESE PRODUCTS AND CONTENT, YOU SIGNIFY YOUR AGREEMENT TO BE BOUND BY THESE T&Cs.

The Backseat Pilot (“TBP”) reserves its rights to amend these T&Cs from time to time without notice. Your continued use of the products and content subsequent to having been notified of such amendments to these T&Cs shall constitute acceptance of these T&Cs as amended.

Limitations on Liability.

All products offered for sale by TBP are so offered “as is” and are, accordingly, purchased by Purchaser as such. TBP does not guarantee that such products will meet Purchaser’s expectations. TBP does not make any express or implied warranty of fitness of the products and content for a particular purpose. TBP further does not make any express or implied warranties of merchantability with respect to these products. Consistent with the foregoing, TBP does not warrant the accuracy of any information contained in the products and content. No information provided in the products and content is intended to serve as a substitute for applicable federal regulations (e.g., Federal Aviation Administration regulations, without limitation) or other appliable governmental laws or regulations. TBP accepts no liability for the content provided, or the consequences of any actions taken on the basis of the information provided.

You agree to waive any claim that you may have against TBP and its agents, servants, employees, contractors, officers, managers, representatives, successors, assigns, subsidiaries, and/or affiliates for any alleged injury sustained as a result of your reliance upon these products or content. Should you bring any claim in violation of this Agreement, you agree that you shall be liable to all defending parties for any and all reasonable attorneys’ fees and other expenses incurred in defending against any such claims.

Should any scenario arise whereby TBP is held liable for monetary damages for injuries sustained by Purchaser due to Purchaser’s use of and/or reliance upon these products and content, the Parties agree that any such liability shall not exceed the amount that Purchaser has expended on the purchase immediately before the alleged damage occurred.

Governing Law and Jurisdiction.

These T&Cs shall be construed in accordance with the laws of the State of Illinois without regard to any conflict of laws provisions. Resolution of any and all disputes related to this Agreement shall be in the state or federal courts within the State of Illinois.

Intellectual Property Rights.

TBP expressly reserves all copyrights and all other intellectual property rights in these products and content. Such rights are owned solely by TBP. Neither anything herein, nor any other communications and/or activity on the part of TBP, shall be construed as a grant of any exclusive rights to such content. Further, to the extent that TBP extends to Purchaser a non-exclusive license to use such content, such license shall at all times remain revocable in the sole discretion of TBP.

Products offered for sale by TBP are so offered for Purchaser’s own personal use. Copies may not be provided to others. These products and content may not be shared or claimed as your own and may not be used to create derivative products for sharing or selling.

The delivery of any products by TBP shall not constitute a transfer of any commercial or promotional use rights in such products. Any downloading or exporting capabilities are solely an accommodation to you and shall not constitute a grant, waiver, or other limitation of any of TBP’s rights.

Although, as a convenience, we do not limit the number of downloads of these products from TBP’s website, we monitor user downloads and reserve the right to revoke access to TBP’s products and content without a refund if they are being shared by Purchaser with third-parties.

Solid Purchase, Good Content

I love that there is a full lesson plan, a condensed lesson plan, and an accompanying PowerPoint presentation and that they match the ACS very closely. I wish the documents were split up into sections instead of having to continuously navigate through 800 page documents each time. I also wish the PowerPoint was a little higher quality, it’s very basic and hard to read at times. Overall I think it was a good value for the amount of content provided as well as the references.

Thanks, Ben! I've got great news! Everything you mentioned (and a bit more) is in the works! Each Knowledge and Risk Management task required by the ACS is being annotated right now (and almost done). Following that, the focus is on improving the quality of the PowerPoints (less text per slide, a more coherent and professionally done design with more color and energy, and more visuals).

I've also already started breaking the lessons into individual files, so you'll have that option as well. In the meantime, to avoid all the scrolling, make sure you're using the Navigation Pane in Word (under the View tab), and the Navigation options in any PDF reader. Those options basically eliminate the scrolling between lessons and make navigating much smoother. Thanks again!
